Business: Viatori Ventures (Pty) Ltd trading as Venturo · Website: www.venturo.co.za · Country: South Africa · Effective date: 01 October 2025 · Last Updated: 01 September 2025

1. Purpose

Venturo respects copyright, trade marks & other intellectual property rights.

This Copyright & Intellectual Property Policy explains:

  • how intellectual property displayed through Venturo is treated;
  • the rights Venturo has in its own original material;
  • how third-party intellectual property may appear on Venturo;
  • the responsibilities of Users & Activity Providers;
  • how copyright or intellectual property concerns can be reported; and
  • how Venturo may respond to infringement complaints.

This Policy should be read together with the:

  • Venturo Terms & Conditions;
  • Privacy Policy;
  • User-Generated Content & Community Guidelines; and
  • applicable Business or Activity Provider Terms.

2. Intellectual Property

Intellectual property may include rights relating to:

  • copyright;
  • trade marks;
  • designs;
  • computer software;
  • branding;
  • photographs;
  • videos;
  • written material;
  • graphics;
  • illustrations;
  • databases & compilations;
  • logos;
  • business names; and
  • other original creative material.

Different intellectual property rights may apply to different types of material.

3. Copyright

Copyright protects qualifying original works under applicable law.

Examples of works that may receive copyright protection include:

  • written content;
  • photographs;
  • graphics;
  • illustrations;
  • videos;
  • software;
  • sound recordings;
  • published material; and
  • other eligible creative works.

Copyright ownership does not necessarily depend on whether a copyright symbol appears on the work.

Users should therefore not assume that material found online is free to copy simply because it does not contain a copyright notice.

4. Venturo Intellectual Property

Unless otherwise stated, original material created by or for Venturo and owned by Venturo may include:

  • the Venturo name & branding;
  • Venturo logos;
  • Venturo visual assets;
  • original website content;
  • original app content;
  • original written descriptions;
  • graphics;
  • illustrations;
  • photographs commissioned or created for Venturo;
  • videos;
  • marketing material;
  • original editorial collections;
  • original design elements;
  • software owned by Venturo;
  • original database arrangements or compilations where protected; and
  • other original creative work.

These materials may be protected by copyright, trade mark law or other applicable intellectual property rights.

5. Copyright Notice

Venturo may display the following notice on its website, application or other material:

© 2025 Viatori Ventures (Pty) Ltd trading as Venturo. All rights reserved.

This notice applies to original material owned by Venturo.

It does not claim ownership of third-party content, trade marks, photographs, logos or other material that belongs to another rights holder.

6. Permitted Personal Use

Users may access & use Venturo Content for ordinary personal, non-commercial use associated with the Venturo Platform.

For example, Users may:

  • view activity listings;
  • save activities;
  • share links to Venturo pages;
  • use information to plan activities;
  • access their account; and
  • use features made available through the Platform.

This permission does not transfer ownership of Venturo intellectual property to the User.

7. Uses Requiring Permission

Unless permitted by applicable law or expressly authorised by Venturo, Users may not:

  • reproduce substantial portions of Venturo Content;
  • republish Venturo Content commercially;
  • copy Venturo descriptions for use on another directory or platform;
  • systematically scrape Venturo's Platform;
  • build a competing database using Venturo Content;
  • copy Venturo branding;
  • use Venturo's logo without permission;
  • reproduce Venturo photography commercially;
  • sell Venturo Content;
  • remove copyright or proprietary notices;
  • falsely suggest an association with Venturo;
  • copy Venturo software or source code; or
  • use Venturo intellectual property in a misleading or unlawful manner.

Requests for permission may be sent to:

legal@venturo.co.za

8. Venturo Trade Marks & Branding

The Venturo name, logo & other distinctive brand elements may be protected under applicable trade mark, copyright or other intellectual property law.

Use of Venturo branding must not:

  • falsely suggest that another business is Venturo;
  • falsely imply sponsorship or endorsement by Venturo;
  • confuse customers regarding the source of a product or service;
  • imitate Venturo in a deceptive manner; or
  • damage or misuse Venturo's intellectual property rights.

Where permission to use Venturo branding has been given, the branding must be used in accordance with any applicable brand guidelines.

9. Third-Party Business Names & Trade Marks

Venturo displays the names, brands, trade marks & logos of independent businesses as part of its activity-discovery services.

Ownership of those trade marks & brands remains with the relevant rights holder.

Displaying a business name or trade mark on Venturo does not mean Venturo owns that intellectual property.

It also does not automatically mean that Venturo operates the relevant business or activity.

10. Activity Provider Content

Activity Providers may provide Venturo with:

  • logos;
  • photographs;
  • videos;
  • descriptions;
  • pricing information;
  • promotional material;
  • event information; and
  • other business content.

When an Activity Provider submits content to Venturo, the provider must have the necessary rights or authority to allow Venturo to use that material.

The applicable Business or Activity Provider Terms may grant Venturo permission to:

  • host the content;
  • resize or format it;
  • display it;
  • reproduce it;
  • include it in business listings;
  • use it within the Venturo app & website;
  • feature it in relevant Venturo collections; and
  • use it to promote the relevant business, activity or Venturo service in accordance with the agreed licence.

Submitting content to Venturo does not automatically transfer ownership of that content to Venturo.

11. Activity Provider Responsibility

An Activity Provider submitting material to Venturo confirms that it has the necessary permission to do so.

A provider should not submit:

  • photographs copied from another photographer without permission;
  • photographs belonging to a competitor;
  • copyrighted marketing material it is not authorised to use;
  • third-party logos without authority;
  • images downloaded from the internet without appropriate rights; or
  • other intellectual property that it is not authorised to provide.

Where a rights dispute arises concerning provider-supplied Content, Venturo may temporarily remove or restrict the disputed material while the matter is investigated.

12. User-Generated Content

Users may submit content through features such as:

  • reviews;
  • comments;
  • photographs;
  • community posts;
  • profile information; and
  • other interactive features.

Users retain ownership of their original User-Generated Content.

By submitting content to Venturo, Users grant Venturo the licence described in the Venturo Terms & Conditions to host, store, reproduce, display, format & distribute that content as reasonably necessary to operate the Venturo Platform.

Users must only upload material that they have the right to share.

13. Content Found on the Internet

Material being publicly accessible online does not automatically mean that it is free for commercial reuse.

This applies particularly to:

  • photographs;
  • videos;
  • illustrations;
  • graphics;
  • articles;
  • marketing copy;
  • logos; and
  • social-media content.

Venturo does not treat the fact that Content appears on Google, Instagram, Facebook, TikTok, another directory, a business website or another public website as permission to copy or commercially reproduce that Content.

Where Venturo wishes to reproduce third-party creative material, it should have an appropriate right, licence, permission or other lawful basis for doing so.

14. Publicly Available Business Information

Venturo may research publicly available information in order to create or maintain activity listings.

This may include factual information such as:

  • business name;
  • business location;
  • publicly advertised operating hours;
  • contact details;
  • booking links;
  • activity categories;
  • publicly advertised prices; and
  • factual information about services offered.

Where Venturo creates editorial descriptions from researched information, Venturo should use its own original wording rather than reproducing substantial portions of another business's marketing copy.

The appearance of factual business information on Venturo does not mean Venturo claims ownership of the underlying business, brand or third-party intellectual property.

15. Photographs

Photographs may be protected by copyright.

Venturo should therefore use photographs where an appropriate right to use them exists.

Examples may include:

  • photographs created by Venturo;
  • photographs commissioned by Venturo with appropriate usage rights;
  • photographs submitted by an Activity Provider under an appropriate licence;
  • photographs licensed from a photographer;
  • appropriately licensed stock photography;
  • content made available under a licence that permits Venturo's intended use; or
  • other photographs Venturo is legally authorised to use.

Attribution alone does not necessarily create permission to use a photograph.

16. Social Media Content

A photograph, video or post appearing on a public social-media account remains subject to applicable rights.

Venturo should not assume it may download & republish social-media content commercially simply because:

  • the account is public;
  • Venturo tags the creator;
  • the business appears in the photograph;
  • another account has reposted it; or
  • the material can be downloaded or screenshotted.

Where social-media content is to be reused by Venturo, appropriate permission or a lawful licence should be obtained where required.

17. Creative Commons & Licensed Content

Venturo may use third-party content made available under Creative Commons or another recognised licence where the licence permits Venturo's intended use.

Venturo must comply with applicable licence conditions.

Depending on the licence, these may include:

  • attribution;
  • linking to the licence;
  • identifying modifications;
  • restrictions on commercial use; or
  • requirements relating to derivative works.

A licence should be checked before the Content is published.

18. Copyright Complaints

If you believe Content appearing on Venturo infringes copyright that you own or are authorised to represent, please contact:

copyright@venturo.co.za

Your notice should provide sufficient information for Venturo to investigate the complaint.

Where possible, include:

  • your full name;
  • your contact details;
  • details of the copyright owner;
  • identification of the original work;
  • the Venturo page, listing or Content concerned;
  • why you believe the use is unauthorised;
  • evidence reasonably supporting ownership or authority;
  • any relevant original source or publication information; and
  • confirmation that the information provided is accurate to the best of your knowledge.

If you represent the rights holder, Venturo may request evidence that you are authorised to act on their behalf.

19. Trade Mark Complaints

If you believe Venturo Content improperly uses a trade mark, business name or other protected brand asset, contact:

copyright@venturo.co.za

or

legal@venturo.co.za

Please provide:

  • the mark concerned;
  • the rights holder;
  • relevant registration information where applicable;
  • the Venturo Content concerned;
  • an explanation of the alleged infringement; and
  • your authority to make the complaint where you act for another party.

20. Venturo's Response to a Complaint

When Venturo receives a sufficiently detailed intellectual property complaint, it may:

  • acknowledge receipt;
  • request additional information;
  • investigate the Content;
  • review records relating to the Content's source;
  • contact the User or Activity Provider that supplied the Content;
  • temporarily restrict the disputed Content;
  • remove the Content;
  • replace the Content with authorised material;
  • restore Content where the complaint is not substantiated; or
  • take further action where appropriate.

Removal during an investigation does not constitute an admission of infringement by Venturo or another party.

21. Content Supplied by Another Party

Where disputed Content was submitted by a User or Activity Provider, Venturo may provide that party with sufficient information about the complaint to allow them to respond.

Personal information will be handled in accordance with the Venturo Privacy Policy & applicable law.

Venturo may request evidence demonstrating:

  • ownership;
  • permission;
  • licensing;
  • commissioning arrangements; or
  • another lawful basis for use.

22. Counter-Information

Where a User or Activity Provider believes Content was removed incorrectly, they may provide Venturo with information supporting their right to use the Content.

This may include:

  • a licence;
  • written permission;
  • an agreement;
  • proof of ownership;
  • details showing the Content was independently created; or
  • other relevant evidence.

Venturo may reconsider its decision after reviewing the information supplied.

23. Repeat Infringement

Venturo may restrict or terminate access for Users or Activity Providers that repeatedly submit Content that infringes third-party rights.

Depending on the circumstances, Venturo may:

  • remove the material;
  • issue a warning;
  • restrict Content uploads;
  • suspend account functionality;
  • remove a business listing;
  • suspend an account; or
  • terminate access to relevant services.

More serious infringements may result in immediate action.

24. False or Abusive Complaints

Intellectual property complaints should be made in good faith.

A person must not knowingly submit false information, impersonate a rights holder or misuse Venturo's reporting process to remove legitimate Content.

Venturo may refuse to action abusive complaints and may take appropriate action against Users who deliberately misuse the reporting system.

25. Evidence & Content Records

Venturo may maintain records relating to the origin & permitted use of Content.

These records may include:

  • who supplied the Content;
  • when it was supplied;
  • applicable licence information;
  • permission correspondence;
  • relevant agreements;
  • original source information; and
  • changes made to the Content.

These records may be used to investigate intellectual property complaints.

26. Removal Requests From Businesses

An Activity Provider may contact Venturo if it believes information or Content associated with its business should be corrected, replaced or removed.

Requests may be sent to:

business@venturo.co.za

Intellectual property complaints should preferably be sent to:

copyright@venturo.co.za

Venturo may verify the request before changing or removing Content.

27. Venturo Listings

A business listing appearing on Venturo does not transfer ownership of the business's intellectual property to Venturo.

Venturo's original editorial material, categorisation, layout, original written Content & other qualifying Venturo-created elements remain subject to Venturo's applicable intellectual property rights.

Businesses may request corrections to inaccurate factual information without acquiring ownership of Venturo's original Platform Content.

28. Linking to Venturo

Businesses, Users & media organisations may ordinarily link to publicly accessible Venturo pages.

Links must not be presented in a way that:

  • falsely suggests a partnership;
  • falsely suggests sponsorship;
  • impersonates Venturo;
  • misrepresents the linked Content; or
  • otherwise infringes Venturo's rights.

Use of Venturo's logo alongside a link may require separate permission.

29. Screenshots & Media Use

Reasonable screenshots of Venturo may be used for legitimate purposes such as:

  • journalism;
  • commentary;
  • reviews;
  • demonstrating a legitimate integration or partnership; or
  • sharing a Venturo activity with others,

subject to applicable law & provided the use does not falsely imply an association with Venturo or commercially reproduce substantial portions of Venturo's protected Content.

Businesses seeking Venturo media assets should contact:

business@venturo.co.za

30. No Transfer of Rights

Except where expressly stated in writing, nothing in:

  • these Terms;
  • a business listing;
  • a User account;
  • participation in a community;
  • submission of Content; or
  • use of the Venturo Platform

transfers ownership of intellectual property from one party to another.

Any licence granted to Venturo operates according to the applicable Terms or agreement.

31. Protection of Venturo's Rights

If Venturo becomes aware that its Content, branding, software or other intellectual property is being used without authorisation, Venturo may take appropriate steps to protect its rights.

Depending on the circumstances, this may include:

  • contacting the party concerned;
